Disability Equality law (BGG)

The goal

The Disability Equality Act (BGG) came into effect on 1 May 2002 with the aim of eliminating disadvantages of disabled people. All facilities which are bound by the BGG must actively promote consider these goals.

To whom does the BGG apply?

The law is obligatory for all public companies belonging to the federal administration. These include departments and agencies of the federal administration, institutions and foundations under public law. For example, the federal government, federal ministries, the Federal Employment Service and the Foundation assistance for disabled children are all bound to the BGG. National administrations must also adhere to the Disability Equality Act as they exercise federal law. These include building design, industrial or environmental protection.

What happens if a public institution does not adhere to the BGG?

The Federal Ministry of Labour and Social Affairs (BMAS) and other recognized registered associations can take action. The can determine if there was an infringement. The associations need not have violated its own rights. A prerequisite is that the complaint may be included in their statutory responsibilities.

The concept of accessibility in BGG

For equality between people with and without disabilities, all barriers in all areas of life must be eliminated. Accessibility does not concern itself just with buildings and transportation but also with communication equipment and systems for information processing. For example, what good is it to make access to public transport accessible, if the ticket machine is not accessible?

Accessibility is defined in The Disability Equality act § 4:

Barriers such as buildings and other facilities such as transportation, technical implementation, information processing systems, auditory and visual information resources and communication facilities, and any other areas which are designed must be accessible and usable by disabled people without any particular difficulty and without foreign assistance.

§11, a separate section for information technology

The information technology regulations are found in §11 of the Disability Equality Act. Websites, publicly accessible intranet and graphical program surfaces must be designed so that they can be used by disabled people without any restrictions.
